As more and more people realize they got scammed and they have to file for bankruptcy, I'm amazed to learn that the bk attorneys are NOT requesting that the bk judge pursue FDRS for refunds to be given to the creditors.
I don't get it, why don't the lawyers advise the trustee that payments that SHOULD have gone to the creditors went to FDRS?
So far I'm not aware of ANY lawyer taking action against FDRS. That means you have to sue yourself. If you have no legal experience, file in the small claims court in YOUR state. In most states, lawyers are NOT allowed and you can just tell the judge what happened.
IMPORTANT: I am NOT an attorney and this is NOT legal advice.
I am an experienced pro se litigant and I learned many lessons the hard way. So if you don't have legal experience, start with SMALL CLAIMS.
You can look up the rules and procedures for YOUR court online. You don't need to use ANY legalese.
Simply state your claim such as:
"FDRS promised to eliminate my debts and to stop the creditors' collection efforts. I paid to FDRS ${total amount], but it did NOT eliminate my debts. I incurred $[total amount] in creditors' late and over limit fees and increased interest. I am requesting a $[total amount] refund and costs."
Just state what your problem is, it could be collection calls, negative credit reporting, creditors suing you, FDRS not answering phones, etc.
Be aware that if you settle with FDRS, you most likely can't sue for additional claims such as having your credit destroyed, getting sued by creditors, being forced in bankruptcy, etc.
That's why it's important to sue for the maximum possible in small claims and just remember that it's better to get something than nothing.
